    Under Part 5 of the Electricity Industry Participation Code (the Code), the Authority is responsible for investigating any suspected or anticipated undesirable trading situations (UTS). If the Authority finds that a UTS is developing or has developed, it may take steps in regard to that UTS.

    The Authority has reached a final decision that the situation existing on 26 March 2011 constitutes a UTS. The reasons for the Authority's decision are set out in the decision document which is at appendix A of the Consultation Paper. The decision document also sets out the proposed actions that the Authority intends to take to correct the UTS.

    Clause 5.4 of the Code provides that if the Authority finds that a UTS has developed, the Authority must immediately advise all registered participants of its findings, and of any actions that the Authority intends to take to correct the UTS.

    The Authority invites submissions on the actions the Authority proposes to take to correct the UTS. To avoid doubt, the Authority is not consulting on its final decision.

    Under Part 5 of the Electricity Industry Participation Code (the Code), the Authority is responsible for investigating any suspected or anticipated undesirable trading situations (UTS). If the Authority finds that a UTS is developing or has developed, it may take steps in regard to that UTS.

    The Authority has reached a preliminary finding that the situation existing on 26 March 2011 constitutes a UTS. The reasons for the preliminary finding are set out in the draft decision document which is at appendix A of the Consultation Paper. The draft decision document also sets out the draft remedial actions that the Authority intends to take to correct the UTS.
