Confidentiality of disclosing participants' information
Q. What information must be kept confidential?
A. The Code requires that information provided by individual participants remains confidential to the registrar. Furthermore the registrar must not release any consolidated information which might allow identification of a participant and by implication commercial information about their business.
Q. Is it ever possible to identify a participant?
A. If a disclosing participant is suspected of breaching the Code, for example, by not providing a statement, then the registrar has an obligation to notify the Authority. The notification will contain the identity of the participant.
Q. What happens if the registrar is not satisfied with the information provided by a participant?
A. The registrar is required to notify us, who will call for an independent audit of the statement under clause 13.236H. The participant will be identified to the Authority in this case but the content of the statement remains confidential to the registrar.
Q. How will irregularities be investigated?
A. The Code requires the participant or the Authority to appoint an independent auditor to investigate the irregularity. Any commercial information including the revised disclosure statement is confidential to the auditor and the registrar.
