Clauses 13.2B-L are effective from 1 April 2021. Those clauses impose obligations on a new class of participants, called major participants, including an obligation to report to the Authority on how major participants are meeting their disclosure obligations under clause 13.2A.

The file below provides a list of participants who are likely to be captured by the definition of major participants.

Each quarter, major participants need to submit a report to the Authority describing:

  1. whether the major participants has a written procedure for determining whether they hold disclosure information
  2. whether or not the major participant held disclosure information;
  3. for any information that was disclosed, where it was disclosed;
  4. for any information that was not disclosed, which exclusion under clause 13.2A(2) was relied on; and
  5. the disclosure information or a description of the information.

The report needs to be certified by a senior member of staff that the information contained in the report is correct.

The Authority has decided that the Wholesale Market Information Disclosure Portal (a web-based portal) is the ‘specified form’ for the purpose of clause 13.2D(2)(b). The Authority may, from time to time, make administrative or operational improvements to the Disclosure Portal. The Authority will engage with stakeholders and clearly communicate changes to the Disclosure Portal. This Portal steps participants through the requirements and contains more detail on what is required within each field each necessary.

All major participants should have received log in details.
