    Consultation on permanent change to definition of disclosure information

    The Authority is consulting with stakeholders on a proposed permanent change to the definition of ‘disclosure information’ in the Code.

    In March 2021 the Authority amended the definition of ‘disclosure information’ in the Code under urgency – this amendment will expire after nine months.

    The Authority is now proposing to make that change permanent. The amendment is intended to align the Code with the Authority’s policy intent.

    Feedback received during the consultation will help inform the Authority’s decision on whether to proceed with the proposal or not.

    The consultation closes at 5pm, Tuesday 3 August 2021.

    Thank you to those who submitted on the Authority’s recent consultation, Wholesale market information disclosure – review of thermal fuels. We intend to decide next steps in December 2020.

    We are now running a short consultation with stakeholders on proposed wording to update the guidelines, open for two weeks and closing at 5pm, Tuesday 3 November 2020.

    Wholesale market information disclosure consultation paper published

    We have published our Wholesale market information disclosure: review of thermal fuel disclosure consultation paper. The paper has four proposals to address the problems identified, including:

    • an amendment to the Code introducing a new reporting regime for parties to tell us what information they have decided not to disclose
    • three other proposals outside of the Code to improve awareness and accessibility of existing information.

    We anticipate that these proposals will increase visibility of market activities and allow participants to better manage risk, which will benefit consumers in the long-term through more efficient prices.

    We encourage interested stakeholders to respond by 5pm, Tuesday, 1 September 2020.

    We will be holding a briefing on Friday, 14 August. Please email WMID@ea.govt.nz to register your interest in attending in person or by video conference. Further details will be in a future Market Brief.

    We have published our Wholesale market information: Review of disclosure regime consultation paper. The consultation paper proposes two amendments to the Electricity Industry Participation Code 2010 (Code) to enable improved wholesale market information disclosure. It also includes an updated version of the Guidelines for participants on wholesale market information disclosure obligations (guidelines). We consider our proposals will further the Authority’s statutory objective primarily by improving competition in, and the efficient operation of, the electricity industry.

    The WAG seeks feedback from interested parties on the Wholesale market information: Review of disclosure exclusions discussion paper. We asked the WAG to investigate whether the current exclusions from making wholesale market information readily available to the public (under subclause 13.2A(2) of the Code) support the efficiency limb of the Authority’s statutory objective.

    The discussion paper explores the issues the WAG has identified. The paper also proposes some options for amending clause 13.2A of the Code to enhance the disclosure of relevant information, and suggests some market facilitation measures.

    The WAG will consider submissions from interested parties before providing advice and recommendations to the Authority.
