Mark Cairns 2022

Auckland International Airport Limited (AIAL) requested an exemption on behalf of Mark Cairns from sections 75, 77-79, and 88 of Part 3 of the Act.  The exemption has been granted with conditions.

Top Energy Limited 2021

Top Energy Limited requested an exemption from complying with the corporate separation (section 76(1)) and arms-length rules (section 76(2)) of the Electricity Industry Act 2010 in respect of 17.87MW of diesel/bio-diesel generation. The exemption has been granted, with conditions.

Tania Simpson

Meridian Energy Ltd requested an exemption on behalf of Tania Simpson from sections 75, 77-79, and 88 of Part 3 of the Act. The exemption has been granted, with conditions.

Robert McDonald 2021

Fletcher Building requested an exemption on behalf of Robert McDonald from sections 75, 77-79, and 88 of Part 3 of the Act. The exemption has been granted, with conditions.

Barbara Chapman and Douglas McKay 2021

Fletcher Building requested an exemption on behalf of Barbara Chapman and Douglas McKay from sections 75, 77-79 and 88 of Part 3 of the Act. The exemption has been granted, with conditions.

Julia Hoare 2020

Auckland International Airport Limited (AIAL) and Meridian Energy requested an exemption on behalf of Julia Hoare from sections 75, 77 - 79, and 88 of Part 3 of the Act. The exemption has been granted, with conditions.

Top Energy Limited 2019

Top Energy Limited (Top) and Ngawha Generation Limited (NGL) requested an amendment to their existing exemption to comply with rule 9 and rule 10 of Schedule 3 of the Act. The amendment has been granted.

This amendment is for two clauses of the principal exemption and makes the following changes:

  1. increases the nameplate capacity of Ngawha Springs Power Station to 75MW
  2. extends the exemption to end at the same time as the NGL’s resource consent, to the close of 31 July 2052.

All other conditions of the original exemption still apply.

We received no submissions or comments in response to the draft decision paper and have published the final decision below which explains the reasons for granting this exemption.
