Current exemptions under Part 3
Under Part 3 of the Act, the Authority has the ability to grant exemptions from complying with the legislation which prohibits the involvement in both an electricity lines business and an electricity supply business.

Top Energy Limited 2019
Top Energy Limited (Top) and Ngawha Generation Limited (NGL) requested an amendment to their existing exemption to comply with rule 9 and rule 10 of Schedule 3 of the Act. The amendment has been granted.
This amendment is for two clauses of the principal exemption and makes the following changes:
- increases the nameplate capacity of Ngawha Springs Power Station to 75MW
- extends the exemption to end at the same time as the NGL’s resource consent, to the close of 31 July 2052.
All other conditions of the original exemption still apply.
We received no submissions or comments in response to the draft decision paper and have published the final decision below which explains the reasons for granting this exemption.
