The Authority has commenced investigations into the following alleged breaches of the Electricity Industry Participation Code 2010 (Code).
- Future Energy New Zealand Limited (Energy Club) alleged that Genesis Energy Limited contacted a Genesis customer who was switching to Energy Club (a save-protected trader), during the save protection period, to persuade the customer to terminate the electricity supply arrangement the customer had entered into with Energy Club. As a save-protected trader, Energy Club is protected from such behaviour under the switch save protection scheme regime in the Code.
- Simply Energy Limited self-reported that it breached clause 10.7 by failing to use its best endeavours to arrange access for the metering equipment provider to be able to replace the current transformers for which certification had expired on 1 April 2015. The end customer at the site had refused access.
- Transpower New Zealand Limited as the system operator self-reported that it had breached clause 13.58A(1)(e)(i) between 28 March and 31 March 2019 when it produced market schedules containing incorrectly modelled special protection schemes (SPSs). The incorrect status of the SPSs caused constraints to be automatically modelled when they should not have been, and constraints not generated when they should have been. The Authority alleged the system operator also breached clauses 13.58A(2)(d)(i) and clause 13.69A of the Code in relation to the same incident.
- The Electricity Authority alleged that Broadspectrum (New Zealand) Limited failed to maintain certification for a number of high-volume metering installations. The breaches were identified in Broadspectrum’s metering equipment provider audit completed on 28 January 2019.
