Undesirable trading situation (UTS) claim

On Thursday, 8 November 2018 we received a claim of an undesirable trading situation (UTS).

The claim has been made by five parties – Electric Kiwi Limited, Flick Energy Limited, Pulse Energy, Switch Utilities Limited and Vector Limited. The claim relates to the period from 15 September 2018 onwards.

We’re well prepared for these situations and have started our process to determine if a UTS exists.

We are in the very early stages of gathering and processing information as part of our investigation of the claim. More information about the expected process and timetable will be provided once the investigation has progressed further.

You can read more about the Authority’s role in investigating a UTS claim in the Guidelines for Participants on Undesirable Trading Situations. As the decision maker on UTS claims, we will not comment until we have completed our investigation.

A copy of the claim is available on our website.
