As part of a first principles review of its compliance framework, the Authority decided to also review the Electricity Industry (Enforcement) Regulations 2010 (Enforcement Regulations), and pass its findings to the Ministry of Business, Innovation and Employment (MBIE). MBIE is responsible for administering the Enforcement Regulations.
The Authority is also reviewing the liability arrangements for all market operation service providers, ancillary service agents, asset owners, and in respect of electricity metering standards and metering information. This includes reviewing the liability limits set out in the Enforcement Regulations, along with the structure of the liability limits and whether they are best placed in the Enforcement Regulations. Since any change to the liability limits for these service providers would require a change to the Enforcement Regulations, it makes sense to consider this issue as part of the review of the Enforcement Regulations.
