The Commission managed compliance with the Rules and Regulations via the Market Governance workstream. Market Governance received breach notifications and undertook initial fact finding to obtain sufficient information to prepare a report and recommendation.

Market Governance reported to the Electricity Governance Rules Committee (EGR Committee). The EGR Committee was a Board sub-committee and was made up of three Board Members. The EGR Committee had certain Board delegations with respect to compliance including:

  • Making decisions in respect of requests for exemptions.
  • Dismissing the notification of an alleged breach.
  • Appointing investigators.
  • Deciding that no formal complaint should be laid with the Rulings Panel.
  • Making recommendations to the Board regarding the Board's decision:
    • to approve settlements, or
    • to lay a formal complaint with the Rulings Panel.

After each EGR Committee meeting, a Market Governance Update was produced. The Updates were intended to:

  • keep market participants informed of topical issues considered by the Committee
  • give an overview of the notifications of rule breaches the Committee considered at its most recent meeting
  • update participants on the Commission's compliance initiatives
  • keep participants in touch with developments from the Commission's Market Governance team.

The Rulings Panel was set up in accordance with the Regulations to make decisions on formal complaints of breaches of the Rules and Regulations.
