Archive - Rio Tinto agreements summary
Clause 16.2 of the Code requires the Authority to continue to publish a summary of the cumulative effect of the Rio Tinto agreements, (being the power supply and transmission agreements for the Tiwai point aluminium smelter, previously known as the "Comalco agreements"), that describes how those agreements may affect each Rio Tinto party's ability to comply with clause 7.2 or 7.11 or Parts 8, 12 or 13 of the Code.
Under clause 17.292 of the Code, the summary published under regulation 201 of the Electricity Governance Regulations 2003 before the Code came into force is deemed to be a summary published under clause 16.2.
On 1 November 2011 the Authority published a revised summary proposed by the Authority after consultation with the parties to the Rio Tinto agreements.
Annual wash-up notification
Under clause 16.7 of the Code each Rio Tinto party must, within 90 days of the end of the financial year, advise the Authority whether any acts or omissions have occurred during that financial year that may have been in breach of certain parts of the Code.
